These terms govern your use of the preventative-maintenance compliance service provided by [LEGAL ENTITY NAME] ("we", "us"). By creating an account you agree to them.

1. The Service

The Service schedules recurring maintenance work, records what your technicians do on site, and generates compliance documents from those records. It can also create jobs in a job-management system you connect, and file copies of documents into cloud storage you connect.

2. Your account

  1. You must give accurate registration details and keep your password secure.
  2. You are responsible for everything done under accounts in your organisation, including those of technicians you invite.
  3. An account holder with owner or administrator rights can add, change and remove other users, connectors and records in your organisation.
  4. Tell us promptly if you believe an account has been compromised.

3. Your data

Your records remain yours. We store and process them to provide the Service, as described in our Privacy Policy. You may export your data at any time. You are responsible for having the right to enter the site, client and personal information you put into the Service.

4. Acceptable use

You must not use the Service to store unlawful content, attempt to access another organisation's data, interfere with its operation, or resell access without our written agreement.

5. Connected services

If you connect a job-management system or cloud storage, you authorise us to send and retrieve data on your behalf using the credentials you supply. Those providers operate under their own terms, and we are not responsible for their availability or their handling of your data once it reaches them. You can disconnect at any time.

6. What the Service is not

This is important. The Service is a record-keeping and scheduling tool. It is not:

  1. a substitute for the professional judgement of a licensed tradesperson;
  2. a certification, inspection or testing authority — the documents it produces record what your technicians tested and found, and are issued by you, under your licence, on your responsibility;
  3. a guarantee that work is compliant with any standard, or that a schedule reflects what any law, standard, contract or insurer requires of you.

You are responsible for confirming that the frequencies, checklists and document wording you configure are correct for your obligations. Reminders may not arrive — because of email delivery, a misconfiguration, or an outage — and you must not rely on them as your only control against missing a compliance deadline.

7. Availability and changes

We aim to keep the Service available but do not promise it will be uninterrupted or error-free. We may change or discontinue features; where a change would materially reduce functionality you rely on, we will give reasonable notice. [STATE ANY SERVICE LEVEL YOU COMMIT TO, OR SAY THERE IS NONE.]

8. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that, and to the maximum extent permitted by law:

  1. we exclude implied warranties;
  2. we are not liable for indirect or consequential loss, loss of profit, loss of contracts, or regulatory penalties; and
  3. our total liability arising from the Service is limited to [the fees you paid in the 12 months before the claim / OTHER CAP].
